Minutes of Okehampton Town Council Planning Committee Meeting held on Monday 23 November 2009 in the Council Chamber, Town Hall, Fore Street, Okehampton at 7.00 pm

351. Apologies for Absence - An apology for absence was presented on behalf of Councillor A Leech.

352. Deferment of Business - (for comment by the public) - There were no members of the public present.

353. Members’ Questions -

354. Minutes - The minutes of the Planning Committee meeting held on 9 November 2009 were approved and signed on the proposition of Councillor C Hodgson, seconded by Councillor M Ireland, subject to minute 334.7 Hand Rail Bridge Behind Waitrose - Councillor Mrs Marsh advised that she had informed the Borough Council.

355. Proposed Development Link Road Okehampton - The County Solicitor (R Gash) attended to explain the position relating to this development.  He said the land had been sold to Mr Hawkins and was subject to covenant, the County were of the opinion that the covenant was unenforceable and were currently negotiating the release of the same for a fee to allow development.  At this point, on the proposition of Councillor Hodgson, seconded by Councillor Ireland, it was resolved to move into part two.

PART TWO

ITEMS WHICH MAY BE TAKEN IN THE ABSENCE OF THE PRESS AND PUBLIC ON THE GROUND THAT EXEMPT INFORMATION MAY BE DISCLOSED (if any).

The Committee is recommended to pass the following resolution:-

“On the proposition of Councillor Hodgson, seconded by Councillor Ireland, it was resolved that under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the Meeting for the undermentioned item of business on the grounds that exempt information may be disclosed as defined in the paragraph given below from Part I of Schedule 12(A) to the Act”

Paragraph 7 - Information relating to the financial or business affairs of any particular person (other than the authority).

355. Proposed Development Link Road (continued) 

It was resolved to come out of part 2, move back into part 1 and ratify all decisions taken in part 2, proposed by Councillor Hodgson, seconded by Councillor Weekes.

Mr Gash was thanked for his attendance.

357. Gambling Act 2005 - The Chairman referred to the renewal of statement of principles for 2010-2013 relating to the Borough Council in its role as licensing authority.  She explained the document related to the principles which guide the Borough when considering applications under the Gambling Act eg preventing gambling from being associated with crime and disorder, ensuring fairness and openness, protecting children and vulnerable people from harm and exploitation.  She explained the bulk of the document was about issuing of licences for all kinds of premises and restrictions and conditions which apply.

Representations were requested by 9 December.  The document was available in the Town Clerk’s office for inspection.  Councillor Mrs Bickley questioned which pubs in town had gambling licences or specifically what licences were held by the public houses in town.  It was suggested the licensing officer attend a meeting to explain.
